How to Sell Off-Plan Property Before Handover

25 September 2026 · 6 min read · Deluxa Real Estate

Thousands of Dubai off-plan buyers want out before handover — relocations, changed finances, better opportunities elsewhere. The exit route exists and is fully legal: the assignment sale. But the mechanics trip up most sellers, and mispricing your equity is expensive. Here is the process, straight.

What an assignment sale is

You are not selling a property — it does not exist yet. You are selling your contract with the developer: the right to the unit, the payments you have already made, and the obligation to complete the remaining payment plan. The buyer steps into your shoes; the developer issues a No Objection Certificate (NOC) and re-registers the sale.

The developer threshold — the rule that matters most

Most developers only permit assignment after you have paid a minimum percentage of the price — commonly 30% or 40%, varying by developer and project. Emaar, Damac, Sobha, Nakheel and Meraas each set their own rules, and some charge an NOC/transfer fee. Below the threshold, a conventional resale is blocked — but structured solutions exist, including deferred-transfer agreements with an institutional buyer who takes over your payments now and completes the registration once the threshold is met.

Pricing your exit

  • Your equity: the sum of instalments paid to date (plus the 4% DLD Oqood fee you already paid)
  • Premium or discount: if the project has appreciated, you can ask above your paid-in amount; in flat phases or urgent sales, expect to recover equity at a discount for speed
  • The buyer's lens: a buyer compares your asking price plus remaining payments against buying the same unit from the developer today — price against that, not against your hopes

Timeline reality: agented off-plan resales routinely take 2–4 months — listing, finding a buyer comfortable with off-plan, developer NOC, Oqood transfer. A direct institutional buyer compresses this to 2–3 weeks because the NOC process starts on day one.
